Insurance covers many of the losses you may have suffered from Hurricane Katrina including structure, contents, loss of use and business interruption. Some insurance companies are attempting to limit the recovery for claims of policyholders (insureds). A homeowners or commercial liability insurance company is not obligated to pay damages caused by a flood, but is obligated to pay for the cost of repairs for damages caused by wind-driven rain. Standing water or saturation in your home or business from above (as opposed to rising flood water) is considered wind-driven rain.

Some insurance carriers are using many different techniques in non-payment, deficient payment and/or late payment of hurricane claims. If you have experienced any of the following, you may want to contact us to discuss your rights pursuant to your insurance policy.

  1. The insurance company sends out multiple adjusters causing the process to start over. Unfortunately, the subsequent claims adjuster doesn't know what occurred in the prior inspection.
  2. The insurance company allocates the loss on "flood" even though wind driven rain contributed to the damages from the hurricane.
  3. The insurance company undervalues a policyholder’s loss by utilizing the pre-Katrina unit cost and prices for materials, labor and expenses.
  4. The insurance companies deny payment for coverages under an insurance policy since a majority of damage was caused by flood.
  5. The policyholder had inadequate insurance to cover losses for home or business.
  6. The insurance companies delay in responding to questions and in issuing payment for damages or additional living expenses (ALE)
  7. The insurance companies fail to timely or fully pay for contents, ALE and business interruption coverage.
